Mr. A
Aboubakary MBodj
Subject: Information
Sir,
We have hereby denounce the arrest of our brother Karim Wade in custody for over a year at the Remand rebeus in Dakar, Senegal.
The CREI was created by an Act of 10 July 1981. But the resulting provisions have not been adopted by the organic law codification of the judicial organization of 02 February 1984.
So CREI was repealed in 1984 Nobody disputes since to revive the CREI, we had a new text. Decree of the President Macky Sall of May 10, 2012.
The CREI is legally non-existent.
The procedure of the CREI violates some major international principles.
First, the presumption of innocence by the procedure of "formal notice" of having to prove the source of funds.
Then the principle of access to remedies excluded by section 13 as guaranteed by the Universal Declaration of Human Rights, the African Charter on Human Rights.
Finally, the principle of equality of arms because only the Special Prosecutor has access to remedies in case of non-place.
Excellence, given all this, how can we guarantee a fair trial Karim Wade?
No this is unthinkable!
If Karim Wade should be prosecuted for his acts and deeds, it would benefit as former Minister of privilege from the jurisdiction of the High Court of Justice, as provided in the Constitution of the Republic of Senegal in Article 101.
We believe that Karim Wade is a political hostage potential opponent of the current regime to win the election handily in 2017.
Today the release of Karim Wade is a social demand for all Senegalese who continue to speak everywhere: in public places, in markets, bus stations, schools, universities, hospitals , in cars, in airplanes, in the street, in newspapers, television and radio stations.
We demand the release of MKP Karim Wade did nothing wrong, since white as snow and is a victim of harassment.
Mr. Secretary General, we found for one (01) months Karim Wade is private access.
What we deplore and condemn in the strongest terms as an inmate must receive visits from his parents, his friends, his supporters ...
We draw your attention to this, because, in a rule of law such as Senegal, Karim rights should be respected.
We MKP require a public hearing for the national and international opinion is well built.
Please accept, Sir, the assurances of our highest consideration and sincere.
The President Karim Movement (MKP)
